Do I need to tell my estate agent if I am advertising
privately as well?
You are under no obligation whatsoever to tell your estate
agent that you are advertising privately. Provided that you
have checked your contract thoroughly and established that
you have not granted them sole selling rights, you should
simply be able to carry out any activities you like alongside
their own activity.
You can look at the question of whether to tell them in one
of two ways:
It’s possible they will react positively to the ‘competition’
of your own selling efforts, by raising their game, marketing
your property more aggressively and generally pulling out
all the stops to ensure that they are successful in generating
a commission.
Alternatively, they may prioritise other sales ahead of yours
if they know that their efforts to find a buyer are not certain
to be rewarded.
Additionally, it is worth considering that letting the estate
agent know about your activities can save some wrangling later
on, as some will try to put pressure on you to pay out their
commission, even though it is not contractually required.
Finally, even if you have granted an agent sole selling rights,
you don’t need to tell them what you are doing, though
you will be legally obliged to pay them their commission should
you successfully find a buyer independently.
