What happens if I am using an estate agent but sell
my house through a buyer from TheMoveChannel.com?
In the vast majority of cases, this is great news as it will
save you hundreds, thousands or even tens of thousands of
pounds in estate agency fees. As long as the agreement that
you signed gave the agent sole agency or multiple agency rights,
you will not need to pay them any commission if you find a
buyer independently.
This is supported by the Office Of Fair Trading in their
guide entitled: “Using an estate agent to sell your
home”, which states that while other agents are prohibited
from marketing a property when you have a sole agency agreement
with one estate agent, you yourself are not classed as an
agent, so are free to advertise the property directly and
will not need to pay a commission to your estate agent if
you successfully find a buyer.
Similarly TheMoveChannel.com is not an agent, but a marketing
platform for the advertisement of properties. We are not selling
the property for you – we do not arrange or conduct
viewings, we do not validate the property particulars, we
do not handle negotiations and we do not get involved with
the sales process.
The only exception (and this applies regardless of whether
you are using this site, any other site on the Internet, local
newspapers, flyers or even word of mouth) is where the contract
that you have signed gives the estate agent “sole selling
rights” as opposed to “sole agency rights”.
This is not normally the case, but if it is, you will be required
to pay the estate agents a commission regardless of by what
method a buyer is introduced. If you do have an existing contract
with an estate agent, you should therefore always check the
terms before you start spending money to attract buyers independently.
